The ground rules
Terms of Use
Please read these before you use the site. We’ve kept them as readable as we can.
Last updated: October 2026
1Welcome, and what these terms are
These Terms of Use govern your use of MedicareKindly (the “Site”). By using the Site you agree to them. If you don’t agree, please don’t use it.
2What MedicareKindly is, and isn’t
MedicareKindly is a free informational and referral service operated by a private company. We provide general educational content about Medicare and, if you request it, introduce you to independent partner organizations whose licensed agents may contact you.
We are not an insurance company, agent or broker. We do not sell, enroll you in, or recommend specific plans, and we are not affiliated with, endorsed by or connected to the U.S. government or the federal Medicare program.
3Information is general, not advice
Content on the Site is for general information only and is not insurance, medical, legal or financial advice. Medicare rules, dates and plan details change, and plans vary by ZIP code, availability and eligibility. Please confirm details with Medicare.gov, 1-800-MEDICARE (TTY 1-877-486-2048), your local SHIP, or a licensed professional before making decisions.
4No guarantees
We make no promise that you will qualify for, be offered, or save money on any plan, that any partner will contact you, or that any partner will offer a particular product. Everything on the Site is provided “as is.”
5Partners are independent
The organizations on our partners page are independent businesses. We don’t control their advice, products or conduct, and listing them isn’t an endorsement. Any relationship you form with a partner is between you and that partner.
6Your consent to be contacted
When you submit a form you authorize us and our partners to contact you as described in the Privacy Policy, including by call, text or email using automated technology. Consent isn’t required to use the Site.
7Using the Site properly
Please give accurate information, be at least 18, and use the Site only for lawful personal purposes. Don’t submit another person’s information without their permission, try to break or overload the Site, scrape it, or use it to send unlawful messages.
8Our content
The text, illustrations, design and code on the Site belong to us or our licensors and are protected by intellectual property laws. You may view and print pages for personal use. Other use requires our written permission.
9Third-party links
Links to other sites are provided for convenience. We don’t control or endorse them and aren’t responsible for what you find there.
10Disclaimer of warranties
To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we don’t warrant that the Site will be uninterrupted or error-free.
11Limit of liability
To the fullest extent permitted by law, MedicareKindly and its owners, employees and affiliates are not liable for indirect, incidental, special, consequential or punitive damages, or for any decision you make based on the Site or on contact from a partner. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
12Disputes
These terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. Any dispute will be resolved by binding individual arbitration in [County, State] under the rules of [Arbitration Provider], except that either of us may bring a claim in small claims court. You may opt out of arbitration within 30 days of first using the Site by emailing us. (Placeholder: site owner to confirm governing law and venue with counsel.)
13Changes and contact
We may update these terms from time to time; the date above shows the latest version. Questions: privacy@medicarekindly.com.
